Here is an example of a Statement of Fact from a January 6 Defendant:

I am one of the hundreds of thousand of protestors that traveled to Washington DC on January 6th 2021 to watch President Trump give a speech. I arrived at the Presidents speech at approximately 1pm. After Trump's speech where he told us to 'peacefully and patriotically' protest, I headed to the US Capitol Building. At approximately 1:30 pm, I stood on the left side of the main staircase leading up to the Capitol on the West Side of the Capitol lawn.

The crowd stood their peacefully for about 20 minutes before I saw a large about of Riot Geared DC Metro Police officers march through the crowd. At this time, the Capitol & DC Police started to throw tear gas grenades and flash bang munitions into the crowd of static protestors.

They did not give any warning or dispersal order before they started this assault. I was harshly affected by the tear gas and felt like I was choking, that I might stop breathing and lose my life. At around 2:05 pm approximately, an officer on the staircase unloaded a pepper spray canister directly in my eyes, nose and throat.

The irritation was overbearing and I had a severe reaction because of my pre existing condition of Asthma. I pleaded with the yet to be identified officer to stop his assault because I was having an allergic reaction and felt my throat closing in Asthmatic shock. I tried to escape and made my way through the crowd, at this time a flash grenade exploded directly in front of me, causing me to have sharp pain in my ears and temporary loss of hearing.
